Probate in Palm Beach County isn’t a disaster, but it takes time, becomes public record, and adds cost. The good news: Florida law gives you several tools to pass assets directly to your loved ones without court supervision. Here’s how each works, roughly what it costs, and when it makes sense.
Why Avoiding Probate Matters in Florida
Florida probate runs through the circuit court. Formal administration — used for most estates above the summary threshold — typically takes several months to more than a year, and the file is open to the public. Probate-avoidance strategies let assets transfer faster and privately. Note that Florida also offers summary administration for estates generally under $75,000 (excluding exempt property) or where death occurred over two years prior, which is a lighter process but still a court filing.
The Lady Bird Deed (Enhanced Life Estate)
Florida is one of the few states that recognizes the Lady Bird deed. It lets you keep full control of your Palm Beach home during your life — you can sell it, mortgage it, or change your mind — while naming who receives it automatically at your death. Because the transfer happens by deed, the home skips probate. It’s a popular, low-cost tool for the family residence and preserves your homestead protections and property-tax benefits during your lifetime.
Beneficiary and Payable-on-Death Designations
Often the simplest fix. Retirement accounts, life insurance, and annuities pass directly to named beneficiaries. Florida bank accounts can be set up as “payable on death” (POD) and brokerage accounts as “transfer on death” (TOD). Real estate and vehicles have their own transfer rules. Review these designations after any major life change — a divorce, a death, a new grandchild in Wellington or Boca — because they override your will.
Funded Revocable Living Trusts
A revocable trust (Florida Chapter 736) is the most comprehensive option. You re-title assets into the trust, and at death your successor trustee distributes them without court involvement. It costs more up front than a deed or a POD form, but it handles complex estates, multiple properties, and incapacity in one structure. The key word is “funded” — an unfunded trust still sends those assets to probate.
Joint Ownership — Use With Caution
Property held as joint tenants with right of survivorship, or as tenancy by the entirety between spouses, passes automatically to the survivor. It’s simple, but adding a co-owner exposes the asset to that person’s creditors and divorce, and can create unintended tax results. Treat it as a targeted tool, not a default plan.
Don’t Forget Homestead
Your primary Palm Beach residence carries constitutional homestead protection (Article X, Section 4) and special inheritance restrictions when a spouse or minor children exist. Some probate-avoidance moves interact with those rules, so the home deserves careful, individualized handling.
